Conditions d’utilisation

1. Objet

Les présentes Conditions Générales d’Utilisation (« CGU ») régissent l’utilisation de l’application mobile Fajr Up (« l’Application »), éditée par Ihsan Apps (« l’Éditeur »).

En installant ou en utilisant l’Application, vous acceptez les présentes CGU sans réserve. Si vous ne les acceptez pas, vous devez cesser d’utiliser l’Application.

2. Description du service

Fajr Up est un accompagnement du sommeil aligné sur les horaires de prière. Elle propose notamment :

  • des horaires de prière calculés hors ligne selon votre localisation ;
  • des rappels (adhan, prières, suhoor) ;
  • une boussole indiquant la Qibla ;
  • un journal de prière ;
  • un réveil Fajr ;
  • et, avec l’abonnement, un accompagnement du sommeil : plans de coucher et de réveil calculés, siestes, statistiques, score d’alignement, mode Ramadan, mode Pause.

Un compte est facultatif. L’Application fonctionne sans compte ; la création d’un compte permet de conserver et de retrouver vos données sur un autre appareil.

3. Horaires et contenus religieux

Les horaires de prière sont calculés à partir de méthodes astronomiques reconnues et de paramètres que vous choisissez (méthode de calcul, école juridique, fuseau horaire). Ils sont donnés à titre indicatif et peuvent différer de ceux de votre mosquée ou de votre autorité religieuse locale. Il vous appartient de les vérifier si la précision est déterminante pour vous.

Aucun contenu de l’Application ne constitue un avis juridique ou religieux. Pour toute question relevant du culte, référez-vous à une autorité compétente.

4. Réveil et réveil Fajr — limitation importante

L’Application met tout en œuvre pour que le réveil se déclenche, mais ne peut pas garantir qu’il sonnera dans tous les cas. Un réveil peut ne pas se déclencher, ou être inaudible, en cas notamment de : appareil éteint ou redémarré, batterie vide, volume coupé ou mode silencieux, mode Ne pas déranger, restrictions d’économie d’énergie, refus des alarmes exactes, mise à jour du système, arrêt de l’application par le système, ou tout autre comportement du système d’exploitation hors du contrôle de l’Éditeur.

En conséquence, l’Application ne doit pas être votre unique moyen de réveil lorsqu’un retard aurait des conséquences importantes (travail, examen, voyage, rendez-vous médical). L’Éditeur ne saurait être tenu responsable d’un réveil manqué.

5. Abonnement « Fajr Up Premium »

Fonctionnalités gratuites. Les outils de prière restent gratuits : horaires de prière, adhan, Qibla, journal de prière, rappel de suhoor, et le réveil à l’heure canonique du Fajr.

Fonctionnalités payantes. L’abonnement ouvre l’accompagnement du sommeil : plans calculés par le coach, siestes, statistiques (sommeil et prière), score d’alignement, rappels de coucher, de sieste et de limite de réveil, mode Pause Fajr, mode Ramadan, et le réveil Fajr personnalisé (l’heure est alors déterminée par le coach en fonction de votre sommeil).

Essai gratuit. Lorsqu’un essai gratuit est proposé, il est réservé aux nouveaux abonnés et n’est accordé qu’une fois par compte App Store ou Google Play.

Prix et reconduction. L’abonnement est proposé en formule mensuelle ou annuelle. Le prix applicable est celui affiché dans l’Application au moment de l’achat, dans votre devise, tel que fourni par la boutique. L’abonnement est à reconduction automatique : il se renouvelle pour une durée identique à son terme, sauf annulation au moins 24 heures avant la fin de la période en cours.

Paiement et annulation. Le paiement est encaissé par l’App Store d’Apple ou Google Play, selon votre appareil. L’annulation se fait dans les réglages de votre compte App Store ou Google Play, et non dans l’Application. La suppression de l’Application n’annule pas l’abonnement.

Remboursements. Ils relèvent exclusivement de la politique d’Apple ou de Google.

Absence de reconduction des contenus. À l’expiration de l’abonnement, l’accès aux fonctionnalités payantes cesse et la restauration des achats doit être effectuée depuis l’Application.

6. Compte et sécurité

Si vous créez un compte, vous êtes responsable de la confidentialité de vos identifiants et de l’exactitude des informations fournies. Vous pouvez demander la suppression de votre compte et de vos données à l’adresse de contact ci-dessous.

7. Utilisation conforme

Vous vous engagez à ne pas : détourner l’Application de son usage, tenter d’en extraire le code source, la décompiler, la modifier, la revendre, l’utiliser de manière illicite, ou perturber son fonctionnement et celui de ses services.

8. Propriété intellectuelle

L’Application, son code, ses textes, ses éléments graphiques, ses marques et son logo demeurent la propriété exclusive de l’Éditeur. Les présentes CGU ne vous confèrent aucun droit de propriété sur ces éléments.

9. Données personnelles

Le traitement de vos données est décrit dans la Politique de confidentialité, qui fait partie intégrante des présentes CGU.

10. Disponibilité et évolutions

L’Éditeur s’efforce d’assurer la disponibilité de l’Application mais ne garantit ni une disponibilité ininterrompue, ni l’absence d’erreurs. L’Application peut être modifiée, enrichie ou retirée à tout moment. Les fonctionnalités peuvent évoluer, y compris entre la version gratuite et la version payante.

11. Limitation de responsabilité

Dans les limites permises par la loi, l’Éditeur ne peut être tenu responsable des dommages indirects, ni des conséquences d’un usage non conforme de l’Application, ni d’un défaut de réveil, ni d’une imprécision d’horaire, ni d’une indisponibilité de l’App Store, de Google Play ou de tout service tiers utilisé.

12. Résiliation

Vous pouvez cesser d’utiliser l’Application à tout moment. L’Éditeur peut suspendre ou résilier l’accès en cas de manquement aux présentes CGU.

13. Modifications des CGU

Les CGU peuvent être modifiées. La date de mise à jour figure en tête du document. La poursuite de l’utilisation vaut acceptation des CGU modifiées.

14. Droit applicable

Les présentes CGU sont soumises au droit français. En cas de litige, une solution amiable sera recherchée avant toute action. À défaut, sont compétents les tribunaux français.

1. Purpose

These Terms of Use govern your use of the Fajr Up mobile application (the “App”), published by Ihsan Apps (the “Publisher”). By installing or using the App, you accept these Terms without reservation. If you do not accept them, you must stop using the App.

2. Service description

Fajr Up is a sleep companion aligned with prayer times. It provides in particular:

  • prayer times computed offline based on your location;
  • reminders (adhan, prayers, suhoor);
  • a Qibla compass;
  • a prayer journal;
  • a Fajr wake-up;
  • and, with the subscription, a sleep companion: calculated bedtime and wake plans, naps, statistics, alignment score, Ramadan mode and Pause mode.

An account is optional. The App works without one; creating an account lets you keep and recover your data on another device.

3. Prayer times and religious content

Prayer times are computed from recognised astronomical methods and the parameters you choose (calculation method, juridical school, time zone). They are indicative and may differ from those of your mosque or local religious authority. It is up to you to verify them if accuracy matters to you.

No content in the App constitutes legal or religious advice. For any question relating to worship, refer to a competent authority.

4. Wake-up and Fajr alarm — important limitation

The App strives to make the alarm ring, but cannot guarantee that it will. An alarm may fail to ring, or be inaudible, in particular because of: device powered off or restarted, empty battery, muted volume or silent mode, Do Not Disturb, battery-saving restrictions, exact-alarm permission refused, system updates, the App being stopped by the system, or any other operating-system behaviour beyond the Publisher’s control.

Therefore the App must not be your only means of waking when being late would have serious consequences (work, exam, travel, medical appointment). The Publisher shall not be liable for a missed alarm.

5. “Fajr Up Premium” subscription

Free features. Prayer tools remain free: prayer times, adhan, Qibla, prayer journal, suhoor reminder, and the Fajr alarm at the canonical time.

Paid features. The subscription unlocks the sleep companion: coach-calculated plans, naps, sleep and prayer statistics, alignment score, bedtime, nap and wake-limit reminders, Pause mode, Ramadan mode, and the personalised Fajr alarm (its time is determined by the coach based on your sleep).

Free trial. Where offered, the free trial is for new subscribers only and is granted once per App Store or Google Play account.

Price and renewal. The subscription is offered monthly or yearly. The applicable price is the one displayed in the App at purchase time, in your currency, as provided by the store. The subscription renews automatically for the same duration at the end of each period, unless cancelled at least 24 hours before the end of the current period.

Payment and cancellation. Payment is collected by the Apple App Store or Google Play, depending on your device. Cancellation is done in your App Store or Google Play account settings, not in the App. Deleting the App does not cancel the subscription.

Refunds. Refunds are governed exclusively by Apple’s or Google’s policy.

No carry-over of content. When the subscription expires, access to paid features ends and purchases must be restored from within the App.

6. Account and security

If you create an account, you are responsible for keeping your credentials confidential and for the accuracy of the information you provide. You may request deletion of your account and data at the contact address below.

7. Acceptable use

You agree not to: misuse the App, extract or decompile its source code, modify it, resell it, use it unlawfully, or disrupt its operation or that of its services.

8. Intellectual property

The App, its code, texts, graphics, trademarks and logo remain the exclusive property of the Publisher. These Terms grant you no ownership rights over them.

9. Personal data

The processing of your data is described in the Privacy Policy, which forms part of these Terms.

10. Availability and changes

The Publisher strives to keep the App available but does not guarantee uninterrupted availability or freedom from errors. The App may be modified, extended or withdrawn at any time. Features may change, including between the free and paid versions.

11. Limitation of liability

To the extent permitted by law, the Publisher shall not be liable for indirect damages, for consequences of non-compliant use, for a missed alarm, for an inaccurate prayer time, or for the unavailability of the App Store, Google Play or any third-party service used.

12. Termination

You may stop using the App at any time. The Publisher may suspend or terminate access in case of breach of these Terms.

13. Changes to these Terms

These Terms may be changed. The update date appears at the top. Continued use constitutes acceptance.

14. Governing law

These Terms are governed by French law. The parties will seek an amicable solution before any action. Otherwise, the French courts have jurisdiction.

تنظّم شروط الاستخدام هذه («الشروط») استخدام تطبيق Fajr Up للهواتف («التطبيق»)، الذي يصدره Ihsan Apps («الناشر»).

بتثبيت التطبيق أو استخدامه فإنك تقبل هذه الشروط دون تحفّظ. وإن لم تقبلها، فيجب عليك التوقف عن استخدام التطبيق.

2. وصف الخدمة

Fajr Up رفيق للنوم متوافق مع مواقيت الصلاة، ويوفّر خصوصًا:

  • مواقيت صلاة تُحسب دون اتصال بحسب موقعك؛
  • تذكيرات (الأذان، الصلوات، السحور)؛
  • بوصلة تحدّد القبلة؛
  • سجلًا للصلوات؛
  • منبّهًا للفجر؛
  • ومع الاشتراك، رفيقًا للنوم: خطط نوم واستيقاظ محسوبة، قيلولات، إحصائيات، درجة توافق، وضع رمضان، ووضع الإيقاف.

الحساب اختياري. يعمل التطبيق دون حساب؛ وإنشاء حساب يتيح حفظ بياناتك واستعادتها على جهاز آخر.

3. مواقيت الصلاة والمحتوى الديني

تُحسب مواقيت الصلاة وفق طرق فلكية معروفة وبحسب الإعدادات التي تختارها (طريقة الحساب، المذهب، المنطقة الزمنية). وهي إرشادية وقد تختلف عن مواقيت مسجدك أو الجهة الدينية المحلية. وعليك التحقق منها إن كانت الدقة مهمة لك.

ولا يشكّل أي محتوى في التطبيق استشارة قانونية أو دينية. ولأي سؤال متعلق بالعبادة، راجع جهة مختصّة.

4. الاستيقاظ ومنبّه الفجر — قيد مهم

يبذل التطبيق ما بوسعه ليُطلق المنبّه، لكنه لا يضمن رنينه في كل الحالات. وقد لا يرن المنبّه أو لا يكون مسموعًا بسبب: إيقاف الجهاز أو إعادة تشغيله، نفاد البطارية، كتم الصوت أو الوضع الصامت، وضع عدم الإزعاج، قيود توفير الطاقة، رفض إذن المنبّهات الدقيقة، تحديث النظام، إيقاف التطبيق من النظام، أو أي سلوك آخر للنظام خارج سيطرة الناشر.

وبناءً على ذلك، لا يجوز أن يكون التطبيق وسيلتك الوحيدة للاستيقاظ عندما يكون التأخّر ذا عواقب مهمة (عمل، امتحان، سفر، موعد طبي). ولا يتحمّل الناشر مسؤولية منبّه فائت.

5. اشتراك «Fajr Up Premium»

الميزات المجانية. تبقى أدوات الصلاة مجانية: مواقيت الصلاة، الأذان، القبلة، سجل الصلوات، تذكير السحور، والاستيقاظ في وقت الفجر الشرعي.

الميزات المدفوعة. يفتح الاشتراك رفيق النوم: خطط محسوبة من المدرّب، قيلولات، إحصائيات النوم والصلاة، درجة التوافق، تذكيرات النوم والقيلولة وحدّ الاستيقاظ، وضع إيقاف الفجر، وضع رمضان، ومنبّه الفجر المخصّص (يحدّد المدرّب وقته بحسب نومك).

التجربة المجانية. عند توفير تجربة مجانية، فهي مخصّصة للمشتركين الجدد وتُمنح مرة واحدة لكل حساب App Store أو Google Play.

السعر والتجديد. يُعرض الاشتراك شهريًا أو سنويًا، والسعر المعمول به هو المعروض داخل التطبيق عند الشراء بعملتك كما توفّره المتجر. والاشتراك مُجدَّد تلقائيًا لمدة مماثلة عند نهاية كل فترة، ما لم تُلغِه قبل 24 ساعة على الأقل من نهاية الفترة الجارية.

الدفع والإلغاء. يتم الدفع عبر App Store من Apple أو Google Play بحسب جهازك. ويتم الإلغاء من إعدادات حساب App Store أو Google Play، لا من داخل التطبيق. ولا يلغي حذف التطبيق الاشتراك.

المبالغ المستردة. تخضع حصرًا لسياسة Apple أو Google.

عدم استمرار المحتوى. عند انتهاء الاشتراك ينتهي الوصول إلى الميزات المدفوعة، ويجب استعادة المشتريات من داخل التطبيق.

6. الحساب والأمان

إن أنشأت حسابًا فأنت مسؤول عن سرية بيانات الدخول وعن صحة المعلومات التي تقدّمها. ويمكنك طلب حذف حسابك وبياناتك عبر عنوان التواصل أدناه.

7. الاستخدام المطابق

تتعهد بعدم: إساءة استخدام التطبيق، أو محاولة استخراج شفرته المصدرية أو فكّها، أو تعديله، أو إعادة بيعه، أو استخدامه بطريقة غير مشروعة، أو تعطيل عمله أو عمل خدماته.

8. الملكية الفكرية

يبقى التطبيق وشفرته ونصوصه وعناصره الرسومية وعلاماته وشعاره ملكًا حصريًا للناشر. ولا تمنحك هذه الشروط أي حق ملكية عليها.

9. البيانات الشخصية

تُوصف معالجة بياناتك في سياسة الخصوصية، وهي جزء لا يتجزأ من هذه الشروط.

10. التوفّر والتغييرات

يسعى الناشر إلى إتاحة التطبيق، لكنه لا يضمن توفّرًا متواصلًا ولا خلوّه من الأخطاء. وقد يُعدَّل التطبيق أو يُثرى أو يُسحب في أي وقت. وقد تتغيّر الميزات، بما في ذلك بين النسخة المجانية والنسخة المدفوعة.

11. حدود المسؤولية

في الحدود التي يجيزها القانون، لا يتحمّل الناشر مسؤولية الأضرار غير المباشرة، ولا نتائج الاستخدام غير المطابق، ولا منبّه فائت، ولا عدم دقة في المواقيت، ولا عدم توفّر App Store أو Google Play أو أي خدمة طرف ثالث مستخدمة.

12. الإنهاء

يمكنك التوقف عن استخدام التطبيق في أي وقت. ويمكن للناشر تعليق الوصول أو إنهاؤه في حال مخالفة هذه الشروط.

13. تعديل الشروط

قد تُعدَّل هذه الشروط. ويظهر تاريخ التحديث في أعلى الصفحة. ويُعدّ استمرار الاستخدام قبولًا بالشروط المعدّلة.

14. القانون المطبّق

تخضع هذه الشروط للـقانون الفرنسي. وفي حال نشوء نزاع، يُبحث عن حل ودي قبل أي إجراء. وإلا فالمحاكم الفرنسية هي المختصة.

1. Tujuan

Syarat Penggunaan ini mengatur penggunaan aplikasi seluler Fajr Up (“Aplikasi”), yang diterbitkan oleh Ihsan Apps (“Penerbit”).

Dengan memasang atau menggunakan Aplikasi, Anda menerima Syarat ini tanpa syarat. Jika Anda tidak menerimanya, Anda harus berhenti menggunakan Aplikasi.

2. Deskripsi layanan

Fajr Up adalah pendamping tidur yang selaras dengan waktu shalat. Fitur utamanya:

  • waktu shalat yang dihitung luring berdasarkan lokasi Anda;
  • pengingat (azan, shalat, sahur);
  • kompas yang menunjukkan kiblat;
  • jurnal shalat;
  • alarm Subuh;
  • dan, dengan langganan, pendamping tidur: rencana tidur dan bangun yang dihitung, tidur siang, statistik, skor keselarasan, mode Ramadan, dan mode Jeda.

Akun bersifat opsional. Aplikasi berfungsi tanpa akun; membuat akun memungkinkan Anda menyimpan dan memulihkan data di perangkat lain.

3. Waktu shalat dan konten keagamaan

Waktu shalat dihitung dari metode astronomi yang dikenal dan parameter yang Anda pilih (metode perhitungan, mazhab, zona waktu). Waktu tersebut bersifat indikatif dan dapat berbeda dari waktu di masjid Anda atau otoritas keagamaan setempat. Anda perlu memeriksanya jika ketepatan penting bagi Anda.

Tidak ada konten dalam Aplikasi yang merupakan nasihat hukum atau agama. Untuk pertanyaan seputar ibadah, rujuklah otoritas yang berkompeten.

4. Alarm dan alarm Subuh — batasan penting

Aplikasi berupaya agar alarm berbunyi, tetapi tidak dapat menjamin alarm berbunyi dalam semua keadaan. Alarm bisa tidak berbunyi, atau tidak terdengar, antara lain karena: perangkat dimatikan atau dinyalakan ulang, baterai habis, volume dibisukan atau mode senyap, mode Jangan Ganggu, pembatasan penghemat daya, izin alarm tepat ditolak, pembaruan sistem, Aplikasi dihentikan oleh sistem, atau perilaku sistem operasi lain di luar kendali Penerbit.

Karena itu, Aplikasi tidak boleh menjadi satu-satunya cara Anda bangun ketika keterlambatan berdampak penting (pekerjaan, ujian, perjalanan, janji medis). Penerbit tidak bertanggung jawab atas alarm yang terlewat.

5. Langganan “Fajr Up Premium”

Fitur gratis. Alat shalat tetap gratis: waktu shalat, azan, kiblat, jurnal shalat, pengingat sahur, dan alarm pada waktu Subuh yang syar‘i.

Fitur berbayar. Langganan membuka pendamping tidur: rencana yang dihitung oleh pelatih, tidur siang, statistik (tidur dan shalat), skor keselarasan, pengingat tidur, tidur siang, dan batas bangun, mode Jeda, mode Ramadan, serta alarm Subuh yang dipersonalisasi (waktunya ditentukan pelatih berdasarkan tidur Anda).

Uji coba gratis. Jika uji coba gratis ditawarkan, uji coba itu hanya untuk pelanggan baru dan diberikan sekali per akun App Store atau Google Play.

Harga dan perpanjangan. Langganan ditawarkan bulanan atau tahunan. Harga yang berlaku adalah harga yang ditampilkan di Aplikasi saat pembelian, dalam mata uang Anda, sebagaimana disediakan toko. Langganan diperpanjang otomatis untuk durasi yang sama pada akhir setiap periode, kecuali dibatalkan paling lambat 24 jam sebelum akhir periode berjalan.

Pembayaran dan pembatalan. Pembayaran ditagih oleh App Store Apple atau Google Play, sesuai perangkat Anda. Pembatalan dilakukan di pengaturan akun App Store atau Google Play Anda, bukan di dalam Aplikasi. Menghapus Aplikasi tidak membatalkan langganan.

Pengembalian dana. Pengembalian dana sepenuhnya mengikuti kebijakan Apple atau Google.

Tidak ada kelanjutan konten. Saat langganan berakhir, akses ke fitur berbayar berhenti dan pemulihan pembelian harus dilakukan dari dalam Aplikasi.

6. Akun dan keamanan

Jika Anda membuat akun, Anda bertanggung jawab menjaga kerahasiaan kredensial Anda dan ketepatan informasi yang Anda berikan. Anda dapat meminta penghapusan akun dan data Anda di alamat kontak di bawah ini.

7. Penggunaan yang wajar

Anda setuju untuk tidak: menyalahgunakan Aplikasi, mengambil atau mendekompilasi kode sumbernya, mengubahnya, menjualnya kembali, menggunakannya secara melanggar hukum, atau mengganggu operasinya maupun operasi layanannya.

8. Hak kekayaan intelektual

Aplikasi, kodenya, teks, elemen grafis, merek, dan logonya tetap menjadi milik eksklusif Penerbit. Syarat ini tidak memberi Anda hak kepemilikan atasnya.

9. Data pribadi

Pemrosesan data Anda dijelaskan dalam Kebijakan privasi, yang merupakan bagian tak terpisahkan dari Syarat ini.

10. Ketersediaan dan perubahan

Penerbit berupaya menjaga ketersediaan Aplikasi, tetapi tidak menjamin ketersediaan tanpa gangguan maupun bebas dari kesalahan. Aplikasi dapat diubah, dikembangkan, atau ditarik kapan saja. Fitur dapat berubah, termasuk antara versi gratis dan versi berbayar.

11. Batasan tanggung jawab

Sejauh diizinkan hukum, Penerbit tidak bertanggung jawab atas kerugian tidak langsung, atas akibat penggunaan yang tidak sesuai, atas alarm yang terlewat, atas waktu shalat yang tidak tepat, maupun atas tidak tersedianya App Store, Google Play, atau layanan pihak ketiga yang digunakan.

12. Penghentian

Anda dapat berhenti menggunakan Aplikasi kapan saja. Penerbit dapat menangguhkan atau menghentikan akses jika terjadi pelanggaran Syarat ini.

13. Perubahan syarat

Syarat ini dapat diubah. Tanggal pembaruan tercantum di bagian atas halaman. Melanjutkan penggunaan berarti menerima Syarat yang diubah.

14. Hukum yang berlaku

Syarat ini tunduk pada hukum Prancis. Pihak-pihak akan mengupayakan penyelesaian secara musyawarah sebelum tindakan apa pun. Jika tidak, pengadilan Prancis yang berwenang.
